General Terms and Conditions
These General Terms and Conditions (GTC) apply to all contractual and pre-contractual relations between the Purchaser and CETEC Systems® GmbH, exclusively in the form at the time the purchaser placed its order. CETEC Systems® is the operator of cetec.co.at and its sub-domains. Any conditions of the customer (buyer, purchaser) standing contrary to or deviating from our general conditions we do not recognize, silence on our part to the conditions of the purchaser cannot be regarded as acceptance or consent. This can not be modified. Technical changes in terms of technical progress and commercial differences in shape, colour and weight remains reserved to CETEC Systems®. The information on weight, measures, capacity, power, colours, etc. are only approximate values. The languages in which contracts, orders and complaints shall be prepared shall be German and English.
2. Order process
The presentation of the products and services listed is not a binding offer on our part but a request for the customer to submit us a binding offer. This offer from the customer can be submitted in oral form, by letter, by fax, by e-Mail or by sending the order in the tool shop, which is directed towards the conclusion of a sales agreement about the goods contained in the shopping cart. After receipt of the order the customer receives an automatically generated e-Mail, to confirm the order and to indicate its details (confirmation of receipt). This order confirmation does not represent an approval of the offer, but should simply inform the customer that the order has been received by us. A contract between the customer and us comes about only when we have confirmed the acceptance of the order in writing.
3. Prices and Delivery costs
All of the prices quoted by are given in euros, including the currently applicable legal VAT. The Purchaser’s dispatch cost sharing is as follows:
within Austria, min. order amount: € 49,99
€5,70 within Austria, €16,35 within Europe
For parcels, exceeding the standard size, we have to invoice relevant charges. We will state those charges in our Confirmation notification. If it should be necessary, for any technical or logistic reasons, to send the order in parts, we will only charge the shipping costs once.
For parcels outside Europe international shipping costs apply. They will be calculated during the order process.
With that the incidental costs for postage and packagings are partly covered, CETEC Systems accepts the rest of the expenses. For packets, that exceed a certain standard size, higher delivery costs will be charged. This will be clearly stated in the confirmation e-Mail. Should delivery due to technical or logistic reasons take place in more than one batch, delivery costs shall only be invoiced once to the customer.
Payment of goods may be effected by way of advance payment or credit card. Where payments are made by credit card the purchase price will be due as soon as the order has been picked and the goods have been sent – CETEC Systems. Payment by mailing cash or checks is not permitted; in the event of loss, the CETEC Systems assumes no liability.
As regular customer you can benefit of orders on account. For orders on account, payment is due in full within 30 days of receipt of the merchandise and the invoice, unless explicitly agreed otherwise. For this we ask you to transfer the amount to one of the stated bank accounts. Upon default of payment, we reserve the right to charge default interest at the legal rate.
We deliver as long as stock lasts. The exact delivery time will be stated on the order confirmation.
6. Reservation of proprietary rights
All goods supplied by CETEC Systems GmbH remain the property of CETEC Systems GmbH until full payment has been made.
7. Right to withdraw
The legal regulations apply. The withdrawal period is 14 days. For contracts governing the delivery of goods, the period starts with the day the goods were received by the costumer and for contracts governing the rendering of services it starts with the day the contract is executed.
The notice of withdrawal has to be sent either in writing by registered post or by e-Mail to: firstname.lastname@example.org. The right of withdrawal does not exist with specially manufactured goods and if the delivered special goods have been unsealed by the customer. With timely cancellation, the purchaser is obliged to return the goods at his expense to CETEC Systems®, 1220 Wien, Lavaterstrasse 5/1/2, undamaged and free of freight charges. After receipt of the returned item it will be checked on completeness, intactness and functionality. If the product is undamaged and complete, the customer will be reimbursed with the purchase price without deduction to the bank account stated by the customer. If the product is damaged or incomplete, we will deduct it from the amount that will be reimbursed to the customer. If no bank account is specified, the repayment shall be performed by means of a postal order sent to the customer address.
Should the product for any reason not satisfy your demand, the product may be returned to, repaired or replaced by CETEC Systems®.
9. Governing law
Only Austrian law excluding UN law relating to contracts for the international sale of goods shall apply.
